Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement

Activity: Dynamic movement workshops (the "Workshop"), organized and run by Jessica St John (the "Organizer").

Venue: Calibar Fitness, 311-4899 Vanguard Road, Richmond, BC [insert legal business name], together with its owners, directors, employees, coaches and agents (the "Facility").

1. Calibar Fitness only provides the venue — it is not responsible for the Workshop

I understand and agree that:

• The Facility only rents the Organizer use of its space, its gym equipment and its washroom. The Workshop is planned, run, instructed and supervised entirely by the Organizer, who is solely responsible for it.
• The Facility does not organize, teach, coach, spot, supervise or program the Workshop, does not choose the exercises, and does not screen participants. Any Facility staff present are not my instructors.
• The Organizer decides which Facility equipment is used and how. I will use equipment only as the Organizer directs, check it looks secure before I use it, and report anything damaged or unsafe to the Organizer right away instead of using it.
• My use of the space, equipment, washroom and change areas is at my own risk.
• If I am injured, or suffer any loss or damage, during or in connection with the Workshop — including while using the Facility's space, equipment or washroom — I will not hold the Facility responsible, and any concern or claim about the Workshop is to be directed to the Organizer, not the Facility.

2. Risks

I understand the Workshop involves strenuous physical activity, including jumping, landing, climbing, hanging, swinging, vaulting, inversions, partner work and bodyweight or equipment-based exercises. Risks include, but are not limited to: sprains, strains, dislocations, fractures, head, neck and spinal injuries, cuts and bruises; falls from bars, rings, boxes or other equipment; contact with other participants, walls, floors or equipment; equipment failure or improper setup; overexertion, dehydration, heart attack or stroke; and negligence on the part of the Organizer or the Facility, including failure to warn of or protect me from these risks.

3. Assumption of risk

I freely accept and fully assume all such risks and the possibility of personal injury, death, property damage or loss.

4. Release and waiver

In consideration of being allowed to take part in the Workshop and use the Facility, I agree to WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Organizer and the Facility, and to RELEASE THEM from all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT.

5. Indemnity

I agree to hold harmless and indemnify the Organizer and the Facility from any and all liability for damage to property of, or personal injury to, any third party resulting from my participation.

6. Health and fitness

I confirm I am physically fit to take part, have no medical condition that would make participation unsafe for me, and will tell the Organizer before starting if anything changes. I am responsible for consulting a physician if I am unsure. I will stop and tell the Organizer if I feel unwell or injured.

7. Rules and conduct

I will follow the Organizer's instructions and the Facility's posted rules, use equipment only as directed, and accept that either the Organizer or the Facility may remove me for unsafe conduct without refund from the Facility.

8. Medical treatment

If I am injured or unable to respond, I consent to first aid and emergency medical treatment, and I am responsible for any resulting costs.

9. Personal property

The Organizer and the Facility are not responsible for lost, stolen or damaged personal belongings.

10. General

This agreement is governed by the laws of British Columbia and binds my heirs, next of kin, executors and assigns. If any part is found invalid, the rest remains in full force. This agreement applies to every Workshop session I attend at the Facility, now and in the future.
